The Transfer Disclosure Statement - TDS - Seller Disclosures for San Diego Home Buyers

The Real Estate Transfer Disclosure Statement (TDS form) is a form that helps sellers comply with Section 1102 of the California civil code. In filling out this form, sellers are providing disclosures about the home that may/may not affect the buyer's decision to purchase the property. The Transfer Disclosure Statement asks such questions as: Is the seller occupying the property?; What does the property already have (oven, rain gutters, garage, water heater, etc., etc.)?; Is the seller aware of any defects in specific parts of the property (interior walls, ceilings, sidewalks, etc.)?; Is there an HOA?; and more. This form also allows for the seller's agent and buyer's agent to disclose items to the buyer. One can certainly learn a lot about a property when a seller takes the time to fill in this form correctly. Some sellers may be exempt from providing this disclosure document to buyers, so be sure to work closely with your exclusive buyer agent to determine if that is the case for the property you are interested in purchasing.
